Terms of Sale

These Terms of Sale govern your purchase of products from Handmade Pasta SRL (“Verdella”, “we”, “us”) via verdella.food. By placing an order, you agree to these Terms.

1. Seller information

2. Products

We sell artisanal dried pasta made with Italian durum wheat, free-range eggs, and whole raw vegetables (spinach, beetroot, or sweet pepper). Products are hand-made and hand-packed in small batches in our atelier in Maramureș.

Allergens: all products contain wheat (gluten) and eggs. Not suitable for those with wheat, gluten, or egg allergies/intolerances. Not vegan. May contain traces from a kitchen that handles wheat and eggs. Full ingredient lists are displayed on each product page and on the physical pack.

Net weight: 250g per pack.

Shelf life: 12 months from production date when stored in a cool, dry place. No refrigeration required.

3. Prices and VAT

All prices on the website are displayed in EUR (€) and include Romanian VAT (currently 9% for food products), unless otherwise indicated at checkout. Prices may change without notice; the price applicable to your order is the one displayed at the time of order confirmation.

Shipping costs are calculated and shown at checkout, based on destination country and order value.

4. Orders and contract formation

  1. Adding items to your cart does not constitute an order.
  2. You place an order by completing checkout and confirming payment.
  3. A contract is formed only when we send you an order confirmation email.
  4. We reserve the right to refuse or cancel orders in cases of suspected fraud, stock unavailability, or pricing errors. If we cancel, we refund any payment received within 14 days.

5. Payment

We accept payments via Shopify Payments, including credit/debit cards (Visa, Mastercard, American Express), Apple Pay, Google Pay, and selected local methods (iDEAL for Netherlands, Klarna where available). Payment is processed at order placement. We never see or store your full card details.

6. Shipping and delivery

We ship to the following countries:

  • Netherlands, Belgium, Austria, Germany, Poland
  • Switzerland (please note: customs/import VAT may apply at destination, payable by the buyer)

Processing time: orders ship within 48 hours of confirmation (Monday–Friday, excluding Romanian public holidays).

Delivery time: 2–6 business days depending on destination. Exact estimates are shown at checkout.

Shipping costs: calculated dynamically. Free EU shipping on orders over €48. Switzerland shipping cost shown at checkout.

Risk of loss or damage passes to you upon delivery to the address you provided. If your parcel arrives damaged, contact us within 7 days at team@verdella.food with photos and we will arrange a replacement or refund.

7. Right of withdrawal (14-day cooling-off period)

Under the EU Consumer Rights Directive (2011/83/EU), you have the right to withdraw from the contract within 14 days from the day you (or a designated third party) take physical possession of the goods, without giving any reason.

How to withdraw

Send an unambiguous statement (email is sufficient) to team@verdella.food stating you wish to withdraw. Include your order number.

Returning the goods

Return the unopened goods to the address provided to you in the withdrawal confirmation email within 14 days of notifying us. You bear the direct cost of returning the goods.

Refunds

We refund all payments received, including original shipping costs (standard rate), within 14 days of receiving the returned goods or proof of return, whichever is sooner. Refunds are issued to the original payment method.

Exception: opened or perishable goods

Under Article 16(d) of the Consumer Rights Directive, the right of withdrawal does not apply to sealed goods which were unsealed after delivery and which are not suitable for return for health protection or hygiene reasons. Opened pasta packs cannot be returned under the 14-day cooling-off right — however, our voluntary Picky Kid Promise (see below) still applies.

8. The Picky Kid Promise (voluntary satisfaction guarantee)

In addition to your statutory rights, we offer a 30-day satisfaction guarantee for any customer whose child does not enjoy Verdella pasta:

  • Email us at team@verdella.food within 30 days of receiving your order.
  • Briefly describe the issue (no proof or returns required).
  • We refund 100% of the product price to your original payment method.
  • You may keep any remaining product — no need to return it.

This Promise is voluntary and additional to your statutory rights. It does not affect your right of withdrawal or your legal warranty rights.

9. Legal guarantee of conformity (2 years)

Under EU Directive 2019/771 and Romanian Consumer Protection law, goods must conform to the contract. If a defect appears within 2 years of delivery, you may request remedy (replacement) at no cost, or, where appropriate, a price reduction or refund. Contact us at team@verdella.food with your order details and a description of the defect.

10. Force majeure

We are not liable for delays or failures caused by events outside our reasonable control, including natural disasters, strikes, postal disruptions, customs delays, or government actions. We will inform you promptly and resume performance once possible.

11. Intellectual property

All content on verdella.food (logos, photos, copy, designs) is owned by Handmade Pasta SRL or licensed to us. You may not copy, reproduce, or use it for commercial purposes without our written consent.

12. Applicable law and disputes

These Terms are governed by Romanian law, without prejudice to any mandatory consumer protection provisions of the country where you reside (per Article 6 of Regulation EC 593/2008, Rome I).

Online Dispute Resolution (ODR)

The European Commission provides an Online Dispute Resolution platform: ec.europa.eu/consumers/odr. EU residents may use it to resolve disputes with online traders out of court.

National consumer authority (Romania)

National Authority for Consumer Protection (ANPC): anpc.ro.

Disputes that cannot be resolved out of court fall under the jurisdiction of the competent courts in Baia Mare, Romania, without prejudice to any mandatory consumer rights.

13. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force.
